3. SMS Messaging Program

Program Description: ContactSack operates an SMS messaging program to deliver service notifications, appointment reminders, follow-up messages, and occasional marketing communications to users who have explicitly opted in.

Message Frequency: Message frequency varies. You may receive messages related to appointment confirmations, reminders, follow-up sequences, and service updates. The number of messages you receive depends on your account activity and the services you have enrolled in.

Message and Data Rates: Message and data rates may apply. Standard messaging rates charged by your mobile carrier may apply to messages sent and received. ContactSack is not responsible for any charges incurred from your mobile carrier.

Opt-In: By submitting your phone number and checking the SMS consent checkbox on our contact form, you are providing your express written consent to receive SMS messages from ContactSack at the phone number provided.

Opt-Out (STOP): You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from ContactSack. After sending STOP, you will receive one final confirmation message, and no further messages will be sent unless you re-opt-in.

4. Description of Services

ContactSack provides the following services as part of its Revenue Recovery System:

Missed Call Text Back: Automated SMS responses sent to callers when a call is missed, designed to re-engage potential customers before they contact a competitor.

Speed-to-Lead Automation: Automated follow-up sequences triggered by new lead inquiries across multiple channels including phone, web forms, and social media.

Unified Inbox: A consolidated communication dashboard that aggregates SMS, email, and social messages into a single interface.

Booking Calendar: An automated scheduling system that allows customers to book appointments directly, with automated confirmation and reminder messages.

Review Automation: Automated post-service review request messages sent to customers to generate online reviews.

Optional Add-On Services: Website builds, social content packages, lead generation campaigns, and competitor analysis reports are available as optional additions to the core system.

5. Payment Terms

Setup Fees: One-time setup fees apply based on the selected service tier (Standard, Advanced, or Premium) as outlined on our Pricing page.

Monthly Subscription: A recurring monthly fee of $497 applies to all active accounts and covers software, automation, hosting, and ongoing support.

Cancellation: You may cancel your subscription at any time with 30 days' written notice. This allows us to properly close out your system and ensure no disruptions to your service. No refunds are issued for partial months.

Add-On Services: Add-on services are quoted and billed separately. Pricing for add-ons is provided at time of engagement.

6. Acceptable Use

You agree not to use ContactSack services to:

- Send unsolicited messages to individuals who have not opted in to receive communications
- Violate any applicable federal, state, or local laws or regulations, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
- Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of our services

ContactSack reserves the right to terminate service immediately for violations of this acceptable use policy.

7. Data Privacy

Your use of ContactSack services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at contactsack.com/privacy-policy for information on how we collect, use, and protect your personal information.

8. Disclaimers and Limitation of Liability

ContactSack provides its services "as is" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, ContactSack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

ContactSack's total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to ContactSack in the three months preceding the claim.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Jefferson County, Missouri.

10. Changes to These Terms

ContactSack reserves the right to modify these Terms of Service at any time. When changes are made, we will update the "Last Updated" date at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
